Terms of Sales
Our Liability to you We are under a legal duty to supply Products that are in conformity with our contract with you.
Our Products are designed for residential use and we do not make any guarantees or warranties about their performance in a commercial environment. We will have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
Before ordering from us, it is your responsibility to check and determine your full ability to receive the Products ordered. This includes ensuring that the Products ordered will pass freely into your room of choice, they fit in that room, can be transported through the door of your flat or room, stairs and doorways, and there are no other issues that could make delivery more complicated or impossible.
If we fail to comply with a contract between you and us, we will be responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms of Sale or our negligence, but we will not be responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if the loss or damage was an obvious consequence of our breach or if the loss or damage was contemplated by you and us at the time we entered into the contract.
The maximum loss or damage we will be responsible for is limited to the price you have paid us for the Product to which the loss or damage you suffer relates.
We do not in any way exclude or limit our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability imposed under the Consumer Rights Act 2015 that is not permitted to be excluded or restricted under section 31 of the Consumer Rights Act 2015; and (d) defective Products under the Consumer Protection Act 1987.
This does not affect your statutory rights. Advice about your statutory rights is available from your local Citizens' Advice Bureau or Trading Standards office.
Events outside our control We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control including acts of god, fire, flood, severe weather, explosions, war (whether declared or not), acts of terrorism or acts of local or central Government or of any other competent authorities provided that: (a) we will take reasonable steps to prevent or minimise the failure or delay; (b) in the event of failure to perform, we will refund you all amounts paid under the affected contract; and (c) in the event of substantial delay, you may cancel your order by notifying us and we will refund you all amounts paid under the affected contract.

Each of these terms operates independently Each of the provisions of these Terms of Sale operates separately. If any court or any other relevant authority decides that any of these paragraphs are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
Updating these terms of sale We may modify or update these Terms of Sale from time to time for reasons including: (a) changes in how our business operates; (b) changes in the legal or regulatory requirements that we must comply with; or (c) changes in how we accept payment from you. However, any order of Products by you will be governed by the terms and conditions available on our site at the time you place the order.
Rights of Third party Any Contract made between you and us is only made between you and us. No third party will have any rights to enforce any of its terms.
Transfer of Rights We may transfer our rights and obligations under our contract with you to another organisation, and we will do our best to notify you in writing if this happens, but this will not affect your rights or our obligations under the contract. We will use reasonable endeavours to tell you in writing in this happens.
Law and Jurisdiction These Terms of Sale are governed by English law. This means that a contract for the purchase of Products made through our site and any dispute or claim arising out of or in connection with it will be governed by English law.
You can bring legal proceedings in respect of this contract in the English courts. However, if you are a resident of Scotland, you may also bring proceedings in Scotland and if you are a resident in Northern Ireland, you may also bring proceedings in Northern Ireland.

Prices The prices shown are inclusive of any value added tax or sales tax. Due to circumstances beyond our control, prices may have to be altered up or down, including any alterations to the rate of value added tax or sales tax. The current price will be shown when you place your order. All prices shown are cash prices in sterling.
Availability All orders for products are subject to the availability of those products and the materials for making the products. We will inform you as soon as possible after receiving your order if, for any reason, the Products you have ordered are not available or are subject to any delay.
If we are unable to supply you with a Product, for example, because the manufacturer is out of stock or because of an error in the price, we will inform you of this by email and we will not process your order.
Please note, for Business clients, we will use our best endeavours to ensure that all items quoted are available on the expected date of delivery. After completing an order, if an item becomes unavailable, Homewings will endeavour to do one of the following:
Replace the items out of stock with a similar good deemed reasonable by the Homewings design team
Wait for the item to return to stock and deliver it at a later time
The client will be informed via email of any action taken in this respect.
Colour of reproduction Homewings take great care with the colours used in the collections. The limitations of colour reproduction and the individual colour settings of your screen may mean a slight variation. Every reasonable care has been taken to ensure that the descriptions are accurate. However, specifications may change.
Language This information is supplied in English only and we will continue to communicate in this way during your agreement with us.

The Homewings Service
The Homewings service (“The Service”) consists of the Site, any tools including communication tools provided via the site, any Homewings branded mobile apps we make available, any pages we operate on third party social media applications, and the content and services we make available through them via the internet or mobile devices (including smartphones and tablets). It also includes the provision by us of associated information, Products and services by e-mail or your mobile device.
The Homewings Service is for use in connection with design service and assistance in relation to extends to United Kingdom jurisdictions only.
The provider of Homewings is Homewings Ltd. You can contact us via our online contact form or at email@example.com. When the Terms make a reference to ‘Homewings’, ‘we’ or ‘us’, that is a reference to Homewings Ltd.
Where we refer to you in the Terms, this also includes any person that accesses or uses Homewings on your behalf.
General The Service is a platform enabling people seeking interior design services ("Clients") to find and select interior designers ("Designers"). Both Clients and Designers are "Users" of the Service. Please be advised: Although Homewings administers the design projects (as described in greater detail below) and establishes certain terms for certain packages offered through the Service (including package features, pricing and options), Homewings is not otherwise a party to the design services and any other offline transactions that may take place between Clients and Designers. Homewings has no control over any claims made by Designers about the Products or services they may offer, or the truth or accuracy of the listings created by Designers, the ability of Designers to provide the Products or services as claimed by Designers (even if through the Service) or the ability of Clients to pay for any Products or services offered by Designers. Homewings does not conduct background checks regarding any Users of the Service.
All Users acknowledge and understand that Homewings is not an employer, broker, agent or insurer for any Users of the Service, whether they be Designers or Clients. Homewings's acceptance of a Designer to the Service should not be construed or otherwise deemed an endorsement or promotion of such Designer and its acceptance relied upon the Designer's representation and warranty to Homewings of the accuracy of information submitted about such Designer. As the Service solely provides a platform and tools for Users to communicate with potential transaction partners, any such transactions are made by all Users at each User's own risk.
Account Types and Registration Anyone may browse the public-facing pages of the Service and take a style quiz, but in order to become a Client or Designer, you must create an account (for Clients) or submit a successful application (for Designers).
Client To become a Client, you must provide your post code, phone number, email address, name and a username and password. You may also register by connecting to your social network. You will also take a style quiz (to help us determine your preferred design styles), provide additional details on your specific room project and select from a variety of design packages which will include a style board, furniture plan, shopping list and instructions from your matched Designer (such packages, "Design Packages").
Designer To become a Designer, you must apply to Homewings for approval. Each application will include your resume and portfolio of your work. Designer applications must be submitted via the Website or by email when instructed by Homewings. Homewings' decision to accept or reject any application is within its sole and exclusive discretion and Homewings is under no obligation to accept any designer. If accepted, Designer is required to enter into the Supplemental Designer Agreement as a condition of becoming a Designer through the Service. Homewings will generate a profile for the Designer on the Service which will feature a portrait picture and portfolio image of the Designer, both subject to the license grants for Your Content.
Account Security Your account is personal to you, and you may not share your account information with, or allow access to your account by, any third party as you will be responsible for all activity that occurs under your access credentials. You agree to use reasonable efforts to prevent unauthorized access to or use of the Service and to preserve the confidentiality of your username and password, and any device that you use to access the Service. You agree to notify us immediately of any breach in secrecy of your log-in information. If you have any reason to believe that your account information has been compromised or that your account has been accessed by a third party, you agree to immediately notify Homewings by e-mail to firstname.lastname@example.org. You will be solely responsible for the losses incurred by Homewings and others due to any unauthorized use of your account.
The Design Service Homewings guarantees that each user will receive design recommendations based on the questionnaire, pictures, videos or other material submitted by the user. Design is inherently subjective, however, and you agree that Homewings cannot and does not warrant or guarantee your satisfaction with design services and/or ideas you receive on the Homewings site. Notwithstanding the foregoing, Homewings will take such reasonable steps, in Homewings' sole discretion, to ensure your satisfaction, including but not limited to those measures set forth in our Refund Policy.
While Homewings makes every effort to portray recommended Products and their colours and materials in the most accurate way on the Website, the displayed colours of the products will depend upon the monitor of the user and cannot be guaranteed by Homewings Ltd. as an accurate portrayal of the actual colour or material of the product. We also make efforts to estimate scale of your space based on photos provided but can’t guarantee that all recommended products will fit your space. It is the Client’s responsibility to measure their space to ensure that items fit prior to purchasing.
While Homewings will attempt to ensure that all retail product links are current in order to assist users with purchasing the products, there is no guarantee that the furniture or accessories recommended by Designers will be available for purchase at all or within a specific time frame defined by the Clients in their questionnaire. If prices are provided as part of the design service recommendation, there is no guarantee that the Client will find the article at the same price when they order. Homewings cannot guarantee availability or workmanship of any products purchased from outside vendors.
Pricing for product and services listed on Homewings.co.uk are quoted in GBP British pounds and are valid only in the United Kingdom. All prices are subject to change.
No material from the Site may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way, except as specifically permitted on the Site, such as through links on Homewings.co.uk to other websites or services. the Site, including all of its information and contents, such as text, data, wallpaper, icons, characters, artwork, images, photographs, messages, graphics, software and the HTML used to generate the pages (“Materials and Content”), is property of Homewings.
Homewings grants you a personal, limited, non-exclusive, non-transferable license to access Homewings.co.uk and to use the information and services contained here. Homewings reserves the right, for any reason or for no reason, in its sole discretion and without notice to you, to revise the products and services described on Homewings.co.uk and to terminate, change, suspend or discontinue any aspect of the Site, including, but not limited to, the Materials and Content on the Site as well as features and/or hours of availability of Homewings, and Homewings will not be liable to you or to any third party for doing so. Homewings may also impose rules for and limits on use of the Site or restrict your access to part, or all, of the Site without notice or penalty. Your items will be delivered, either through Consolidated SMART deliveries or Multiple Retail deliveries.

Consolidated SMART deliveries Any products with a SMART label are available through our quick and convenient SMART delivery service. This allows you to have all your items delivered in one batch within 3 weeks of placing your order and - most importantly - at a time that suits you. We’ll make sure to take the items to the right room too, and remove the packaging on request.

Provided you contact us before Midday the day before delivery, there is no charge. However, as our logistics partners load our vehicles the day before delivery, in the rare event that cancellation occur within this period, the following charges are liable -

Are there other ways to shop? For the best experience, we recommend Homewings SMART, however you can also shop in the following ways: Any products with a RETAIL or LONG LEAD TIME label are ordered by your Concierge directly from the relevant sellers (delivery times, charges and T&Cs determined by each vendor).
Items with a SELF-SERVICE label would be ordered by you, directly from the vendor.
Items with an ON SALE label are temporarily discounted and can go out of stock or change price.
Items with a MADE TO ORDER label are made to measure and can’t be returned.
Delivery Charges and Lead Times For SMART, the lead time is usually 2 to 3 weeks. Our third party logistics supplier will be in touch with a choice of delivery dates once your final product has arrived in our warehouse, but before then, feel free to contact your concierge for further updates.
For most of the UK, for orders over £1,000 the SMART service is offered for free. For orders below this, there is a charge of £49. There is an additional £50 charge for the Scottish Highlands, Northern Ireland and Southern Ireland.
For items delivered outside of the Homewings SMART service, shipping times will vary. Once your orders have been placed, we will provide you with your tracking numbers, expected delivery dates and each vendor’s contact information. Any shipping costs we quote come from our vendors and we are always transparent about this charge.
Storage Costs for consolidated SMART deliveries. After your items have been consolidated, you will normally wish to take delivery as soon as possible. However, should you require us to hold the items for longer, we will store them for free for 30 days. If storage for longer than this be required, a weekly charge of 1% of the retail price will be made.
Additional Services Hanging of prints, mirrors and pendant lighting and interior styling These services are only available in certain locations and are carried out by a recommended Homewings third party contractor. Please contact firstname.lastname@example.org for availability and pricing.

RETURNS FORM We have a 14 days standard return policy on unwanted items. How do I qualify for free returns?
On the day of delivery, our delivery partners will remove the packaging of the items on request. At this point, you can refuse the items and and our partners will remove them free of charge. For this reason, if at all possible, we advise you to be available during the delivery. What happens if I’m not available during the delivery?
If you’re not available to send items back on the day of delivery, or you decide, within 14 days, you wish to return an item, there are the following collection charges -

If the goods have been used and are not in new condition, this may affect your refund and you will be contacted by a member of staff once the goods have returned in our warehouse. If the item is found to be unsuitable while on site, please notify the team to return it.
The item has arrived damaged, but I still wish to keep it
Please send us a photo of the item and damage to firstname.lastname@example.org. Ideally, this should also be flagged to our delivery partner during delivery. Our team will then review the damage, and if we feel the item arrived with damage, and this damage occured prior to you taking ownership of the goods, we will offer a percentage refund. Alternatively, provided the damage was highlighted within 14 days, we can collect the item, and issue a full refund.
How will I be refunded?
This will happen once the item has been restocked in our warehouse and checked for signs of defects or damage. This might take within 7-10 working days and then we will refund you on your bank account within 10-15 working days.
When will I see my refund in my account? Refunds should be visible 48 hours after our team confirms the refund via email.
Returning an order - over 14 days As we're based online, we understand that sometimes a piece of furniture might not be quite what you imagined. So we give all of our customers 14 days to return any item - even if it's not damaged.
If 14 days have passed since the delivery of your goods, we are unable to process any refunds unless the product is damaged or faulty.
The item has arrived but won’t fit into the room of my choice If the item does not fit in the room of your choice, please ensure you refuse delivery and the carrier can take it away immediately. Alternatively please contact us within 14 days of delivery to organise a collection My order contains a bespoke or made-to-order item - am I eligible for a return?
Made to order items cannot be returned and a refund cannot be offered.This is because these pieces are made specially for you under your instruction and it is unlikely that we can sell them to another customer at full price, therefore the goods cannot be restocked. Wallpaper and cut by the meter fabric can also not be returned and can not be refunded, this is because these items are ordered upon your request and are classed as special order items. We are unable to return such items to our suppliers unless faulty.
Risk and Ownership
Ownership of the Products will pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.
The Products will be your responsibility from the time that you (or a third party other than the carrier and indicated by you) take physical possession of the Products.
At our discretion we may offer design packages at discounted prices. These promotions are valid from the time that we introduce them to the end date of the promotion. They cannot be used for purchases before the promotion introduction date or after the promotion end date.
In the event that a customer has made a design package purchase and the price of the purchased package is discounted owing to a promotion, the price of the product at the time of purchase shall prevail. We are unable to apply promotion discounts for purchases that have already been made.
Promotions are contingent on availability, we may change the terms of promotions, or withdraw them altogether, at any time, and without prior notice.
Homewings reserves the right, at our absolute discretion, to offer different personalised promotions and it will therefore only be possible for the customer in receipt of the promotion to redeem the discount.
Discounts and credits cannot be used in conjunction with any other promotions.
Unless otherwise stated, we only allow one promotion code to be used per design package order.
GDPR, Privacy & Personal Data Security
Information Received by Homewings Homewings collects and processes the following personal information about you only if you voluntarily choose to share such information with Homewings:
information such as your name, address, phone number and email address, which you provide by completing forms through the Service, upload or submit any material via the Service or request any information from us; in connection with an account sign-in facility, your log-in and password details; communications you send to us, for example to report a problem or to submit queries, concerns or comments regarding the Site, Service or its content; We may also require you to provide us with your financial information, including billing name, address and credit card number (“Financial Information”) where you choose to use our Service.
Information from surveys, promotions and competitions that we may, from time to time, run on the Site, if you choose to respond to, or participate in them;
Video/Photos you may upload, work experience and other information we may suggest or you decide to upload to your Profile.
You are under no obligation to provide any such information to us. However, you may not be able to take full advantage of particular opportunities provided through the Service.
When you visit and interact with the Site, homewings.co.uk and/or third parties with whom homewings.co.uk has contracted to provide services to homewings.co.uk, may automatically collect your Internet Protocol Address (“IP Address”), which is a number that is automatically assigned to the computer that you are using by your Internet Service Provider.
This number is identified and logged automatically in our server log files whenever you visit the Site, along with the time(s) of your visit(s) and the page(s) that you visited. We use IP Addresses to monitor the regions from which Users navigate the Site and for fraud prevention purposes.
Homewings' Use of Personal Information Homewings uses the personal information that you provide to us for the following purposes:

Although we ensure that our third-party agents (“Agents”) receiving your information are bound by privacy restrictions at least as restrictive as those set forth in this policy, Homewings is not responsible for any issues that may arise regarding the Privacy Policies of any of its affiliates or advertisers.
When you visit the Site or access any Homewings applications, Homewings may automatically collect additional information about you, such as the type of internet browser or mobile device you use, as well as any website from which you have come to the Site or application. You cannot be identified based on this information and we use it for analysis purposes to:
Market the Service; Improve and enhance the Service so that it operates more effectively; Increase the likelihood that a group’s experience with the Service is relevant to its interests as a whole.
Homewings uses data at User level to sell products and services to Users who express an interest in these products and services, through a poll for example, or to Users who can be presumed to have an interest based on browsing habits. Homewings may use your cell phone number to call or text you in order to facilitate the provision of the Service. Homewings security of collected information Your Homewings account is password-protected so that only you and authorised Homewings staff have access to your account information. In order to maintain this protection, please do not give your password to anyone. If someone represents to you they are Homewings staff and asks for any personal account information, including your password, check their URL. If it doesn’t say they are firstname.lastname@example.org, they aren’t. Also, if you share a computer, you should sign out of your Homewings account and close the browser window before someone else logs in. This will help protect your information entered on public terminals from disclosure to third parties.
Homewings makes every effort to ensure that your information is secure on its system by backing up data in separate back-up drives and uses public key access encryption and firewalls on both our main and backup servers. We also employ customer record managers to protect against loss, misuse and alteration of the information under our control. Extremely sensitive information, such as credit card numbers, is always transmitted in encrypted form.
Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, Homewings cannot absolutely guarantee the security of any information you transmit to us, and would like to remind you that you are doing so at your own risk.
Homewings may disclose Personal Information from both private and public areas of the Site at our discretion, if required by law or by a court order, or if we are given reason to believe, based on our sole discretion, that someone is causing injury to or interference with the rights of Users, the general public or Homewings.
Finally, in the event that Homewings undergoes a re-organisation or is sold to a third party, Homewings reserves the right to transfer, sell and/or distribute all information collected through the Service to an affiliate, subsidiary, or third party.
How can Users edit their information? You have a legal right under the Data Protection Act 1998 to a copy of all the personal information about you held by us. Upon request, we will provide you with a copy of this information, subject to a fee not exceeding the prescribed fee permitted by law.
You also have a right to correct any errors in any information we hold about you. To update your personal info, click My Account at the top of any page. By submitting information via the Site or application, you agree to this storing, processing and transfer.In addition, if you use our Service whilst you are outside the EEA, your information may be transferred outside the EEA in order to provide you with the Service.
Choice/Opt-Out You may opt out of receiving communications from us and our partners, remove your information from our database and choose to not receive future communications unrelated to the Service.
If you purchase anything through Homewings, we may occasionally contact you with information about special events, sales, activities, promotions, contests, submission opportunities and programmes. You always have the option to ask Homewings not to contact you with this information again. If you receive unsolicited email from a Homewings-related domain, please contact us at firstname.lastname@example.org.

If you have technical problems, questions or other issues related to your use of the Service, Site or any Homewings application, please use the chat function found on most pages of the Site. Homewings’s staff will respond to all requests sent through mail or email from Users interested in knowing more about what personal information is stored on Homewings’s database, or if they want their personal information nullified, or have additional questions regarding privacy.
